When a loved one's death is caused by the negligence of another, Ohio law provides the right to specific compensation to survivors and beneficiaries of the decedent for the following:
- Loss of support from the reasonably expected earning capacity of the decedent;
- Loss of services of the decedent;
- Loss of the society of the decedent, including loss of companionship, consortium, care, assistance, attention, protection, advice, guidance, counsel, instruction, training, and education suffered by the surviving spouse, minor children, parents, or next of kin;
- Loss of prospective inheritance to the decedent's heirs at law at the time of death;
- The mental anguish incurred by the surviving spouse, minor children, parents, or next of kin.
All wrongful death claims must be formally filed within two years of the date of death. Also, wrongful death claims are often accompanied by claims for the pain and suffering experienced by the decedent prior to death.
