A claim for medical malpractice involves two elements: -- a breach of the standard of care and an injury that proximately results from that breach. Proof of a medical malpractice claim usually involves the use of an expert witness. The expert must devote more than 50 percent of his professional time to the clinical practice or teaching of medicine. Once a client's medical records have been obtained, and the appropriate expert is selected, the expert will review the records and render an opinion as to whether there has been a breach of the standard of care, and what injuries resulted from the breach.

Acts of medical malpractice can involve a physician's failure to diagnose a disease or illness, the failure to properly perform surgery or a medical treatment, the performing of unnecessary surgery or medical treatment, and incorrectly interpreting diagnostic tests and studies, to name a few. Malpractice claims can also involve the actions of hospital nurses or other employees. In addition, claims can be pursued against nursing homes for the care and treatment of their elderly residents.

The injuries that can result from medical malpractice, and for which the law provides the right to compensation, include death, permanent disability, physical pain, emotional distress, a loss of enjoyment of life, permanent disfigurement or scarring, medical bills and lost wages, to name a few.
